The Supreme Court declared the fifth Constitutional amendment illegal on Tuesday that had allowed religion-based political parities to flourish in the country and added “Bismillah-ar-Rahman-ar-Rahim” in Constitution, paving the way for the government to ban Islamic groups. This will also help the Government to restore 1972’s Constitution.
Law minister Shafique Ahmed said Bangladesh's original Constitution will be restored with the Supreme Court's dismissal Tuesday and he also mentioned "The spirit and values of the Liberation War will be re-established with the petitions cancelled; the Constitution of 1972 will be restored,". Law minister also said, “The government will initiate all necessary measures to build a secular society and give democracy an institutional shape." Awami League MP Suranjit Sengupta also told parliament Tuesday that the Supreme Court's dismissal of the two petitions had "paved the way for Bangladesh's return to its original Constitution framed in 1972".
After six days of hearing A six-member bench , led by chief justice Md Tafazzul Islam, dismissed the two leave-to-appeal petitions which was filed by opposition BNP Secretary General Khondker Delwar Hossain and three other lawyers. On its ruling the bench said: "Petitions are dismissed with modification and observation." Though they didn’t mention about the modification and observation in detail yet.
